We assist our clients in the Probate Process.  “Probate” is the court-supervised process of administering the estate of a deceased person (the “decedent”), and distributing estate assets to beneficiaries and/or heirs.  Probate is necessary when there is a Will and when there is no Will to pass ownership of the decedent’s assets to the beneficiaries.  At the Law Office of Patricia H. Davis, also practices Guardianship law.  A “Guardianship” is when an individual is appointed by the Court to exercise the legal rights of an incapacitated person, or an adult with developmental disabilities.  A guardianship is also required when a minor receives a monetary amount (from an inheritance, life insurance policy, wrongful death or personal injury claim) in excess of $15,000.00.

Temporary Guardianship (Temporary Custody) is when a family member (who is the non-legal parent of a minor child such as a grandparent, aunt, or uncle) needs to obtain temporary custody of a child.  There are times when the legal parents are unable to care for, or provide for their minor children.
